Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 307, 379/34 and other allied sections of the Indian Penal Code.
Prosecution's case in short is that the accused persons came to the house of the informant with weapons and started abusing his father. On protest, petitioner nos. 3 and 5 caught
Patna High Court CR. MISC. No.11559 of 2022(3) dt.22-09-2022 2/3 hold of informant's father and mother and other petitioners assaulted them by means of farsa and sword causing them grievous injuries. They also snatched gold chain and cash Rs.20,000/-.
Learned counsel appearing for the petitioners submits that there is general and omnibus allegation of assault against petitioner no. 3 and 5. parties are agnate and due to partition dispute the instant occurrence took place. Petitioners have got no criminal antecedent.
Considering the nature of allegation against the petitioners no. 3 and 5, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in Chakia Police Station Case No. 196 of 2021/GR No. 4263 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure. In view of the fact that the injuries caused by petitioner nos. 1, 2, 4 and 6 have been found to be grievous in nature, prayer for bail of these petitioners is refused with direction to surrender and seek regular bail which would be
