The petitioner seeks bail in Kishanpur P.S. Case No. 06/2016, registered for the offences punishable under Sections 452, 380, 382 of the Indian Penal Code and sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

Two persons were committing theft of motorcycle of the informant. The informant raised alarm and on chase one thief namely, Shri Ram Mallah was apprehended. Shri Ram Mallah disclosed the name of the petitioner as one of his accomplices. Learned counsel for the petitioner submits that the petitioner is in custody since 07.09.2016. The petitioner was not apprehended on the spot. Name of the petitioner figured in the confessional statement of co-accused Shri Ram Mallah. Shri Ram

Considering the facts aforesaid and the fact that the petitioner is in jail for about 07 months, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S.
