JUSTICE CHAKRADHARI SHARAN SINGH) 28-01-2022 The matter has been taken up for online hearing through video conference because of COVID-19 pandemic restrictions.

After some argument, learned counsel for the petitioner seeks permission to withdraw this application to assail the order of the Sub-Divisional Officer-cum-Licensing Authority, Mahua, Vaishali dated 30.01.2021, whereby her licence to run a fair price shop under Bihar Targeted Public Distribution System (Control) Order, 2016 has been cancelled,

Patna High Court CWJC No.6582 of 2021(2) dt.28-01-2022 2/2 before the Appellate Authority.

It is the petitioner's case that the said order has been passed without any notice against proposed cancellation. This application stands dismissed as withdrawn with a liberty to the petitioner as sought for. It is observed that if the petitioner prefers an appeal within four weeks from today with an application seeking condonation of delay, the application for condonation of delay shall be considered liberally and the petitioner's appeal shall be decided on merits. It goes without saying that the Appellate Authority shall be obliged to consider all the points which may be taken by the petitioner in her appeal before the Appellate Authority and pass a reasoned order within the time stipulated under the provisions of the said Control Order, 2016.
