JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Kadamkuan P.S. Case No. 334 of 2014 for the offence under section 366(A) of the Indian Penal Code.
FIR was lodged by the mother of the alleged victim on 22.7.2014 that present petitioner is the relative of the informant has kidnapped her minor daughter.
In this case vide order dated 11.5.2017 case diary was called for. Counsel for the State on the basis of case diary and the statement under section 164 of the Cr.P.C., Annexure-2 of the petition submits that allegation against the petitioner is supported by the victim. Patna High Court Cr.Misc. No.20145 of 2017 (3) dt.05-06-2017 2/2 was pressurized by the petitioner Sanjeev Kumar to accompany him and she was taken to Patna Junction but while he was in queue for purchasing ticket she fled away and voluntarily reached the residence of her Phuwa. The petitioner is the son of Phuwa of the alleged victim.
In view of the statement made under section 164 of the Cr.P.C. and the fact that the petitioner is a close relative of the informant and the fact that the petitioner is in custody since 12.8.2014, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Fast Track Court-II, Patna, in connection with Kadamkuan P.S. Case No. 334 of 2014 (now S. tr. No. 201/15) on the condition that the petitioner will not, in any manner, influence the evidence or the witnesses and will extend full cooperation in the completion of the trial.
