JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-06-2020 The petitioners seek bail in connection with Barsoi P.S. Case No. 55 of 2019, dated 14.03.2019, instituted for the offence under Sections 302, 120 (B)/34 of the Indian Penal Code.

The daughter of the informant viz. Sadeka Khatoon who had married one Sukru is said to have been killed by the petitioners by hanging her. The petitioner No. 2 is the sister-in-law of the deceased whereas petitioner No. 1 is the husband of petitioner No. 2. The informant is not an eye witness to the occurrence and the suspicion against the petitioners is because of their standing in some relation to the husband of the deceased. It has also been submitted that petitioner No. 2

Patna High Court CR. MISC. No.9726 of 2020(3) dt.01-06-2020 2/2 has given birth to a child inside jail.

They are in custody since 30.11.2019.

Considering the nature of accusation against the petitioners and their period of custody as also taking into account that one of the accused persons namely Md. Samrul who is the cousin brother-in-law of the deceased has been granted bail, the petitioners are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I class, Katihar in connection with Barsoi P.S. Case No. 55 of 2019 The application stands allowed.
