JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-09-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Mahisi Police Station Case No. 170 of 2019 registered for the offences punishable under section 307 and other allied sections of the Indian Penal Code and section 25(1-B)a/26/35/27 of the Arms Act .

As per the prosecution case, petitioner is alleged to have fired on the informant as a result of which he sustained injury on his right shoulder.

Learned counsel for the petitioner submits that there is a case and counter case. Alleged injury was caused on the non-vital part of the body. Petitioner is in custody since 2.7.2020.

No.21996 of 2021(4) dt.07-09-2021 2/2 Learned counsel for the State opposes the prayer for bail and submits that the doctor has found that the fire arm injury caused by the petitioner was grievous in nature. Moreover, petitioner has got criminal antecedent. In view of the nature of accusation, petitioner's prayer for bail is refused.
