JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioner and Mr. Shantanu Kumar learned A.P.P. for the State. The petitioner seeks bail in connection with Excise Case No. 26 of 2021 instituted for the offences under Sections 30(a) & 33 of the Bihar Prohibition & Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 09.12.2021, prosecution report submitted and is a person with clean antecedent and allegation is of recovery of 130 liters of liquor from the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner was not arrested from his house and the house is a joint family property and as such petitioner is not knowing who

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 09.12.2021 and prosecution report submitted and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, West Champaran at Bettiah in connection with Excise Case No. 26 of 2021.
