JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 04-01-2022 Heard both the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Lalganj P.S. Case No.372 of 2020 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

Taking into consideration the nature of allegation, where 300 litres of liquor was recovered from an open place and the petitioner was standing in nearby area, prima facie, it cannot be established that it is a case under Excise Act, I am inclined to grant anticipatory bail to the petitioner.

The petitioner, above named, in the event of arrest he shall be released on bail on sum of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the
