The petitioner seeks bail in connection with Koilwar P.S. Case No. 19 of 2017, registered under Sections 25(1b)a/26/35 of the Arms Act. The accusation is that in course of checking of the vehicle, signal was given to stop the truck bearing registration no. JH-02L-8905 but the driver of the truck accelerated the speed but anyhow the truck was intercepted while the driver and one other person started to flee away. On chased, both persons were apprehended, who disclosed their name as Raju Kumar Yadav (petitioner) and Bittu Kumar Tiwary and on search petitioner was found in possession of one country made pistol and three live

Learned counsel for the petitioner submits that petitioner has no criminal antecedent except Kiolwar P.S. Case No. 18 of 2017 instituted under Sections 30 and 56 of the Bihar Excise Amendment Act, 2016, regarding seizure of liquor from the truck, which was being driven by this petitioner and in the present case, he is in custody since 31.01.2017. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, at Ara, in connection with Koilwar P.S.
