2. Heard Mr. Sushil Kumar Singh, learned counsel for the petitioner and Mr. Satyavrat Verma, learned Additional Public Prosecutor (APP) for the State.

3. This is the third attempt for anticipatory bail as earlier such prayer was rejected on 17.09.2016 in Cr. Misc. No. 38312 of 2016 and, thereafter, again in the second application filed for anticipatory bail, the same was also dismissed due to noncompliance of the order dated 25.07.2017 in Cr. Misc. No. 30202 of 2017.

4. The petitioner apprehends arrest in connection with Nabinagar PS Case No. 83 of 2016 dated 15.06.2016, instituted under Sections 406, 409, 420/34 of the Indian Penal Code.

5. After some arguments, learned counsel for the petitioner submitted that the application be disposed off with liberty to surrender before the Court below and seek bail.

6. In view thereof, as prayed for by learned counsel for the petitioner, the application stands disposed off with liberty aforesaid.

7. If the petitioner surrenders and prays for bail before the Court below, the same shall be considered on its own merits, in accordance with law, without being prejudiced by the present order.
