After some arguments, Mr. Vishwanath Prasad Singh, Senior Advocate for E.O.U. assisted by Mrs. Soni Srivastava, pointed out that the earlier anticipatory bail application of the petitioner was rejected vide Annexure 1 to the present application on merits by a Co-ordinate Bench of this Court. There is no further fresh ground to reconsider the second anticipatory bail application of the petitioner. Learned Senior Counsel has relied upon the case of G.R. Ananda Babu versus

Patna High Court CR. MISC. No.16733 of 2020(6) dt.04-04-2022 2/2 State of Tamil Nadu & Anr. reported in MANU/SC/0139/2021; LL 2021 SC 48.

Considering the same, the present application stands disposed of, in connection with Darbhanga Town P.S. case No.5 of 2017 pending in the court of C.J.M., Darbhanga, with the liberty to the petitioner to appear before the court below and pray for regular bail.

If any such application is filed by the petitioner before the court below, the court below shall consider the case of the petitioner on its own merit without being prejudiced by this order.
