Petitioner is languishing in custody for the offences punishable under Sections 406, 420, 285, 326, 427 and 308 of the Indian Penal Code and subsequently Section 302 of the Indian Penal Code was also added.
The petitioner has shop of scrap materials. A gas cylinder exploded thereat causing death of few persons. Submission of the petitioner is that nothing incriminating was recovered thereat nor any other gas cylinder, whereas allegation is that the petitioner is indulged in the business of refilling. No other gas cylinder nor any instrument used for the purpose was recovered nor any staff of the petitioner has been
Patna High Court Cr.Misc. No.5906 of 2017 (3) dt.27-03-2017 injured in the occurrence. Petitioner has falsely been implicated on suspicion.
There is no other material in the case diary as informed by the learned Addl. P.P.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-7, East Champaran at Motihari/Successor Court, in connection with Sugauli P.S. Case No.119 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
