JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2015 It is submitted that petitioner no.1, Sonu Tiwary has been arrested, hence the application with regard to petitioner no.1 is disposed of.

The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 302, 341, 342, 323, 324, 307, 379, 504, 506 and 120B of the Indian Penal Code.

It is alleged that Thakur Rai, Suresh Rai, Ajimullah Bukhari, Sahid Bharti, Asif Raja assaulted the brother of the informant who succumbed to the injuries. Petitioners Sonu Tiwari and Sachin Tiwari assaulted the other brother of the informant whereas it is alleged against the petitioner Jai Kishore Tiwary that

Patna High Court Cr.Misc. No.5364 of 2015 (2) dt.10-02-2015 2/2 he confined the informant in a room when others assaulted the informant. A statement has been made in para 16 of the petition that no injury report of the informant or his other brother is on record and considering the same other accused persons have been granted anticipatory by this Court vide Cr. Misc. Nos. 34945 of 2014 and 36927 of 2014.

Considering the aforesaid facts, let the above named petitioner nos. 2 and 3 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, West Muzaffarpur in connection with Sahebganj P.S. Case No. 185 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
