The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 452, 504, 506, 380 of the Indian Penal Code and 3(1) (iv) (x) of the S.C./S.T.(Prevention of Atrocities) Act. The prosecution case is that on 16.04.2015 at about 5.30 A.M. in the morning petitioner and others were laying plinth for construction of the house of Jairam Yadav. On protest being made, the petitioner abused the informant by calling caste name and threatened to leave the village. It is also alleged that accused persons took away cutting crops kept in the house of the informant. It is submitted by the learned counsel for the petitioner that for the occurrence of 16.04.2015 the First
Patna High Court Cr.Misc. No.4775 of 2016 (2) dt.04-02-2016 Information Report was registered on 24.04.2015. The thrust of accusation is against Jairam Yadav. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the accusation in the background of land dispute and the thrust of accusation is against Jairam Yadav, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Anil Kumar, Additional Chief Judicial Magistrate, Munger in connection with S.C and S.T. P.S. Case No. 12 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
