The arbitration order dated 26.09.2016 passed by the Additional Collector-cum-Arbitrator, Kaimur at Bhabua in Misc. Case No. 166 of 2014-15 is under challenge in this writ petition.

Learned counsel for the petitioner is permitted to withdraw this writ petition and file an appropriate application under Section 34 of the Arbitration And Conciliation Act, 1996 This writ petition is permitted to be withdrawn. As and when such an application is filed by the petitioner, the same shall be heard and disposed of in accordance with law within a

Patna High Court CWJC No.19002 of 2018(3) dt.25-08-2022 2/2 period of four months from the date of its filing. The limitation should not come in the way of consideration of the application under Section 34 of the Arbitration Act in view of the fact that the petitioner has availed the alternative remedy before the High Court.
