JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Lakhisarai P.S. Case No. 348 of 2014 registered under Sections- 307, 302, 34, 120B of the Indian Penal Code and 27 of the Arms Act.

The petitioner is named in the first information report with allegation that he opened fire upon the informant. Learned counsel for the petitioner submits that one co-accused, Sanjeet Kumar Bind was arrested by the police in connection with the present case and his statement under Section 164 of the Cr.P.C. was recorded in which he admitted his guilt

Patna High Court Cr.Misc. No.5141 of 2015 (2) dt.06-02-2015 2/2 disclosing this fact that he alongwith two others committed the murder of deceased and so far as the petitioner is concerned, he only directed him and other accused to commit the murder of deceased.

Regard being had to the facts and circumstances of the case as well submission of the parties, I am not inclined to grant privilege of anticipatory bail to the petitioner in connection with Lakhisarai P.S. Case No. 348 of 2014 and accordingly, his prayer for anticipatory bail stands rejected. (Hemant Kumar Srivastava, J) A.K.V./- U T
