The present writ petition has been filed by the petitioner for following reliefs:- (i) for issuance of a writ of Mandamus or any other appropriate Writ/Writs, Order/Orders, Direction/Directions commanding the concerned Respondents not to construct 'Panchayat Sarkar Bhawan' on the lands of the Petitioner and adjacent to their lands as due to such proposed construction, on amongst other problems the main and proper way of commutation to the respective houses of the Petitioners will be blocked permanently causing them permanent difficulties and sufferings although
Patna High Court CWJC No.2739 of 2025(2) dt.25-02-2025 2/2 there is proper and much bigger government land for such construction within 500 meters of the proposed construction site.
(ii) for issuance of a writ of Mandamus or any other appropriate Writ/Writs, Order/Orders, Direction/Directions commanding the concerned Respondents to construct the proposed 'Panchayat Sarkar Bhawan' on the other available proper and much bigger government land for such construction within 500 meters of the proposed construction site as undisputedly by way of such construction on the lands of the Petitioner and adjacent to their lands, the fundamental rights of the Petitioners to live with human dignity would be infringed and they will be subjected to permanent sufferings.
(iii) For any other relief / reliefs for which the Petitioner is entitled under law.
3. Learned counsel for the petitioner submits that the part of the proposed Bihar Sarkar Bhawan comprises the part of Khata No. 42, Khesra No. 1015/2340 area 0-11-2 dhurs, which was settled by the State Government to the petitioner.
4. The petitioner, if so advised, may raise his grievance before the Collector, Supaul who shall decide the representation of the petitioner, in accordance with law.
5. With these observations, the writ petition stands disposed of.
