JUSTICE RAJIV ROY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 16-01-2024 The petitioner is aggrieved with the rule which specifically provided that any teacher who is in a substantive vacancy, whether employed as a regular hand or a contractual hand, on dying in harness, the dependent will be granted an appointment as a Niyojit Teacher. The petitioners contended that as dependents of regular hands or contractual hands they have to be given an identical post on compassionate appointment.

2. We are not convinced that such right exists but as of now, the very post of Niyojit Teachers, has been abolished.

3. In such circumstance, it is for the State to formulate the policy, if at all required, for the purpose of compassionate appointment.

4. We make it clear that this is not a direction to frame the policy.

5. We only close the writ petitions leaving open the

37/37 contention of the petitioners. Leaving the question open to be agitated in an appropriate case.
