Petitioners are apprehending their arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The prosecution case is that the informant being the Manager of a grocery shop was coming on his pickup with the driver having grocery materials, they were intercepted by three motorcycle borne criminals, and took away the loaded pickup van, leading to registration of First Information Report against unknown. The name of the petitioner sprang up during investigation on the confession of co-accused Ranjan Kumar @ Rajan Kumar and one other.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.8494 of 2016 (2) dt.22-02-2016 petitioners that due to enmity after three months of lodging of the case the name of the petitioner sprang up. No recovery has been made from the possession of the petitioners. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Garkha P.S. Case No. 156 of 2015, pending in the court of learned A.C.J.M.- IV, Saran.
With this observation this application is disposed of.
