The application is for grant of bail in connection with Kaler PS case no. 31 of 2015 for the offence under Sections 341, 147, 148, 149, 323, 504, 506, 307, 302 of the Indian Penal Code.

It is submitted on behalf of petitioner that there is no specific allegation of assault against the petitioner and there is only general and omnibus allegation of assault against the petitioner and others. It is further submitted that petitioner is in custody since 31.07.2016 and other co-accused have already been granted bail vide order dated 30.10.2015 passed in Cr.Misc. no. 41780 of 2015, vide order dated 23.05.2016 passed in Cr.Misc. no. 16952 of 2016 and vide order dated 29.09.2016 passed in Cr.Misc.

He has not controverted the aforesaid fact Having heard both sides. In view of the submissions as stated above, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Kaler PS case no. 31 of 2015 subject to the condition that :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court and on the event of failure on his part to appear before the Court below on two consecutive dates without showing any
