The petitioner seeks bail in Barahara P.S. Case No. 288/2016, registered for the offence punishable under Section 414 of the Indian Penal Code.

The house of the petitioner was raided and from the house of the petitioner Ravi Mahto gold ornaments and cash Rs. 12,000/- was recovered. Ravi Mahto confessed his guilt and disclosed the name of other accused persons Chhotu Singh and Dhananjay Mahto. Ravi Mahto also disclosed that he committed theft of ornaments.

Learned counsel for the petitioner submits that Chhotu Singh has already been released on bail vide order passed in Cr. Misc. No. 53025/2016. The recovered article was not put on Test

Patna High Court Cr.Misc. No.11203 of 2017 (2) dt.10-03-2017 2/2 Identification Parade. The petitioner is the owner of the articles recovered from his house and the petitioner is in jail since 25.09.2016.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Barhara P.S. Case No. 288/2016.
