JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-12-2022 The petitioner has a grievance that in the light of this Court's order dated 18.07.2016 passed in CWJC No. 825 of 2012, though, the amount of gratuity has been paid to the petitioner, benefits of Assured Career Progression have not been extended to him.

Ms. Sweta Raj, learned counsel has submitted that this Court had directed the opposite parties to consider the petitioner's claim for grant of Assured Career Progression. Show-cause reply has been filed on behalf of the State from which it appears that in a meeting held on 06.11.2019, the petitioner's claim for amount of Assured Career Progression

Patna High Court MJC No.3757 of 2018(8) dt.07-12-2022 2/2 was considered and the same was not found admissible as on the said date.

In view of such stand taken on behalf of the State, learned counsel for the petitioner seeks the liberty from this Court to question the correctness of the said decision refusing to grant the petitioner benefits of Assured Career Progression. With the aforesaid liberty, contempt proceeding stands dropped as in the Court's opinion no case is made out of deliberate disobedience of this Court's order. (Chakradhari Sharan Singh, J) anand/- U
