The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 149,307, 427, 382, 379 of the Indian Penal Code and Section 27 of the Arms Act.
The Accusation is of cutting wheat crop by 36 and some unknown persons from the field which was shown by informant, Ramadhar Ram, and nine others.
Learned counsel for the petitioners submits that they are innocent and have been falsely implicated. He submits that the land in question belongs to the petitioners. He submits that similarly situated co-accused have been granted anticipatory
Patna High Court CR. MISC. No.9394 of 2020(2) dt.29-02-2020 2/2 bail by a coordinate Bench of this Court in Cr. Misc. No. 47604 of 2019 on 31.07.2019. He further submits that petitioners bear no criminal antecedent.
In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran at Bettiah in connection with Mainatand Police Station Case No. 35 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
