The petitioner is apprehending his arrest in connection with Rajauli P.S. Case No. 460/2021 dated 11.09.2021, registered for the offence punishable under Sections 30(a), 30(d) and 41 of the Excise Act pending in the Court of learned Exclusive Special Excise Court-II, Nawada. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.11046 of 2023(2) dt.25-04-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order considering this fact that some of the co-accused persons have already been granted anticipatory bail by a Coordinate Bench of this Court.
