Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 353, 186, 323, 341, 504/34 of the Indian Penal Code. It is alleged that a case of theft of electricity was lodged against the petitioners hence being annoyed with the action of the authorities, the petitioners attacked on the Electric Supply Centre and made assault to the employee. It is submitted by the learned counsel for the petitioners that First Information Report does not reflect as which employee was assaulted. The First Information Report was lodged on 08.01.2013 but the First Information Report was transmitted to the learned Additional Chief Judicial Magistrate
Patna High Court Cr.Misc. No.6198 of 2015 (2) dt.16-02-2015 on 13.01.2014 which suggests that First Information Report has been registered by ante dating.
Considering the delayed transmission of the First Information Report, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Bihta P.S. Case No. 24 of 2014, pending in the court of learned Additional Chief Judicial Magistrate, Danapur, Patna With this observation this application is disposed of.
