JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mahila P.S. Case No. 130 of 2018 registered for the offences punishable under Sections 498A, 406 and 354/34 of the Indian Penal Code.

Allegation against the petitioner is of subjecting opposite party No.2, wife to torture physically and mentally and further allegation is that her father-in-law is a characterless person, who tried to outrage her modesty and further allegation against the petitioner is that he has illicit relationship with another lady. Submission of learned counsel for the petitioner is that all the allegations are false and concocted and as a matter of fact she is not ready to live with the petitioner in her sasural. Heard learned APP and learned counsel for opposite party

Patna High Court CR. MISC. No.10780 of 2019(4) dt.03-05-2019 2/2 No.2, who has opposed the prayer for anticipatory bail and submitted that she is still ready to live with the petitioner. In view of the allegations leveled by opposite party No.2 against the petitioner and also her father-in-law, there does not appear that there is chance of reconciliation, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Bhojpur, Ara, in connection with Mahila P.S.Case No. 130 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation and after charge sheet has been submitted he has to co-operate in disposal of trial and appear before the court as and when required.
