The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 353, 337, 338, 427, 504 and 506 of the Indian Penal Code.
It is alleged that during election at the polling booth stones were pelted on each other between the two groups. When the police tried to pacify, then the police personnel also received injuries.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.5134 of 2015 (2) dt.06-02-2015 petitioners that accusation is against the First Information Report named accused persons and 40-50 unknown.
Accusation is not specific, though the injuries received by the police personnel were found simple and superficial in nature. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Manpur P.S. Case No. 79 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
