This application is for grant of bail in connection with Terhagachh P.S.Case No.49 of 2016 (G.R.No.1230 of 2016) for the offence under Sections 302/201 of the Indian Penal Code. It is submitted on behalf of the petitioner that except the confessional statement, there is nothing against the petitioner uptill-now and he is in custody since 1.12.2016. Heard learned A.P.P. also.

Having heard both sides. From perusal of the record, it appears that the case is still in the investigation stage, as such at this stage, I am not inclined to grant bail to the petitioner, however, the petitioner may renew his prayer for bail after submission of the charge-sheet before the learned court below itself and the learned court below will consider this aspect of the

Patna High Court Cr.Misc. No.7961 of 2017 (2) dt.23-02-2017 2/2 matter as to whether there are any materials except that confessional statement or not and considering the above facts, he will pass an appropriate order.

With the aforesaid observation, this application is disposed of.
