The petitioner is languishing in custody since 23.12.2018 in a case registered for the offence punishable under Section 392 of the I.P.C.

The prosecution case as per the written report of Kamlesh Sharma submitted to the SHO, Jehanabad Police Station is to the effect that the petitioner used to work in a company at Daman. On 5.12.2018 at 6.00 A.M., the informant got down at Jehanabad Railway Station and thereafter he was being taken by the driver of one white coloured Indica car but when the informant made protest, the persons sitting inside the car took cash of Rupees One Thousand and ATM card of the informant on gun point and made the informant to disclose the pin number of the ATM card, leading to registration of FIR against the unknown driver and owner of the car in question. It is submitted by learned counsel for the petitioner that the petitioner has not been put on Test Identification Parade and co-accused Chandan Paswan has been granted bail by a coordinate Bench of this Court vide order dated 19.2.2019 passed in Cr. Misc. No.9960 of 2019.

Learned APP submits that the name of the petitioner sprang up on confession of co-accused.

Considering the fact that no recovery has been made from the petitioner, till date the petitioner has not been put on Test Identification Parade, statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge I, Jehanabad in connection with Jehanabad P.S.
