Petitioners apprehend their arrest in connection with a case registered under Sections 147, 148, 149, 341, 323, 379, 324, 307 and 504 of the Indian Penal Code.
Allegation in brief is that accused persons assaulted the informant. Specific allegation against Ashok Yadav is that he gave axe blow over the head of father-in-law of the informant and also others assaulted with iron rod.
Submission on behalf of the petitioners is that petitioners and informant are agnates and due to construction of toilet, both sides quarreled and there is case and counter case
Patna High Court Cr.Misc. No.6750 of 2017 (2) dt.22-02-2017 2/2 between both sides and no sharp cutting injury was found on the head of the father-in-law of the informant. Injuries found on the head are simple in nature and these petitioners have no criminal antecedent.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, namely, Ashok Yadav @ Ashok Kumar Yadav, Santosh Yadav @ Santosh Kumar Yadav and Laddu Yadav @ Laddu @ Pankaj be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of 1st Class Judicial Magistrate, Darbhanga in connection with Kamtaul P.S. Case No.136 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
