2. The petitioner is apprehending his arrest in connection with Udwant Nagar P.S. Case No. 396 of 2025 for the offence under sections 316(2), 318(4), 351(2) and 351(3) of BNS lodged on 09.08.2025 by the informant, Amit Kumar.

3. As per the prosecution story, the informant alleged that for a piece of land, he transferred altogether 9 lakh 50 thousand, but later, the petitioner chose to look the other way and feeling cheated, the FIR.

4. In this case, the Coordinate Bench issued notice to

2/4 the opposite party no. 2 who has since appeared and after deliberation and on instruction, learned counsel for the petitioner submits that though he reserves his right to contest the matter in accordance with law, is ready to make payment to the tune of Rs. 9,50,000/- but as he has suffered financial crisis, be allowed to pay the aforesaid amount in installment in the following manner:- "(i) Rs. 1,50,000/- at the time of execution of bail bond;

(ii) Rs. 1,00,000 each by 10th of every month starting 10th of August, 2026 uptill 10th of March, 2027 totalling Rs. 8,00,000/-;

(iii) failure to make the payment in any month, the informant shall be free to take steps for the cancellation of bail bond."

5. Learned counsel for the informant submits that if the petitioner is ready to make the payment, reserving the right, has no opposition, if relief is granted.

6. Taking into account the submission of the parties as also the fair stand taken by the petitioner and he do not have any criminal antecedent, in that background, this Court is inclined to extend him the privilege of anticipatory bail with conditions

3/4 subject to payment of Rs. 9,50,000/-, as recorded above.

7. It is made clear that if the petitioner defaults, the informant will have the right to take steps for cancellation of his bail bond.

8. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Udwant Nagar P.S. Case No. 396 of 2025 subject to the following conditions:

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhaar Card/Voter ID Card/Pan Card/Driving License) to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall be appearing before the Police Station as and when required for cooperating in the investigation;

4/4 (iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Adnan/- U T
