The petitioner apprehends his arrest in Jhajha P.S. Case No. 384 of 2020, registered for the offences punishable under Sections 363, 365 of the Indian Penal Code. As per the prosecution case, petitioner with the help of other co-accused persons forcibly taken away the mother of informant.
It is submitted that petitioner has been falsely implicated in this case merely on suspicion. Informant is not eye-witness of the occurrence. FIR has been lodged after delay of approximately three months without any plausible explanation. It is next submitted that during course of investigation brother of informant did not support the
Patna High Court CR. MISC. No.12499 of 2022(2) dt.16-08-2022 2/2 prosecution case rather he categorically stated that his mother was missing from Jhajha market. Similarly situated co-accused have been granted bail by this Court vide order dated 01.02.2022 passed in Cr. Misc. No. 28169 of 2021. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No. 384 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
