ANJANA MISHRA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 366(A), 120(B)/34 of the Indian Penal Code.

Counsel for the petitioner submits that the victim girl is a major and as per the First Information Report itself, she had gone along with the petitioner on her own sweet-will. However, the victim girl in her statement under Section 164 Cr. P.C. has stated that the petitioner had sprinkled something so as to cause her to be unconscious and, thereafter, the petitioner took her away in a village in West Bengal.

Considering the nature of allegation made and the statement

Patna High Court Cr.Misc. No.4831 of 2016 (3) dt.11-05-2016 P2/2 of the victim girl recorded under Section 164 Cr. P.C., I am not inclined to grant anticipatory bail to this petitioner in connection with Sherghati P.S. Case No 85/2014. It is accordingly rejected. (Anjana Mishra, J) Saif/- U T
