JUSTICE SHIVAJI PANDEY ORAL ORDER 22-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual Court proceeding. In this case, the petitioner is seeking regular bail in connection with Alamganj P.S. Case No. 387 of 2018 (Sessions Trial No.197 of 2019) registered for the offence under Section 304B of the Indian Penal Code.
The petitioner is the husband of the deceased. Allegation has been made against the petitioner that he has killed his wife.
This Court vide order dated 02.03.2020 had called for the status report and the status report dated 06.06.2020 shows that out of nine witness four witnesses have been examined.

No.9987 of 2020(3) dt.22-06-2020 2/2 Learned counsel for the petitioner submits that the matter is very old one and only four witnesses have been examined till date, so the petitioner requires sympathetic consideration in view of the fact that he has already spent two years jail custody.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner for the present. Accordingly, the prayer for bail is rejected. However, the Trial Court is directed to conclude the trial within nine months after restoration of normal Court functioning. If the trial is not concluded within the aforesaid period, as indicated above, the petitioner is at liberty to approach this Court for bail. (Shivaji Pandey, J) pawan/- U T
