JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although, the present case has been registered under the provisions of S.C./S.T. (Prevention of Atrocities) Act as well as under various sections of the Indian Penal Code but according to prosecution case itself, the alleged occurrence took place in the office of the informant which does not appear to be a public place. Moreover, the petitioner also lodged Pirpainti P.S. Case No. 231 of 2014 against the informant and others for the occurrence of the same day and in the said occurrence, petitioner is said to have received injury on his head.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/

Patna High Court Cr.Misc. No.5189 of 2015 (2) dt.06-02-2015 surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Pirpainti P.S. Case No. 232 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
