Petitioner is in custody since 26.11.2016 in connection with S.T. No. 06 of 2017 arising out of SalkhuaP.S. Case No. 81 of 2015 registered under Sections 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence. In fact, the petitioner has not been named in the F.I.R nor any recovery has been made from the conscious possession of the petitioner. There is no eye witness to the alleged occurrence and mere on the basis of antecedent of the petitioner, he has been made accused by the police in this case and he is rotting in custody for the last five months. Considering the nature of accusation, let the petitioner,
