This is an application for bail in connection with Warisaliganj P.S.Case No. 200 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 509, 448, 380, 307 of the Indian Penal Code and Sections 25(1 b) a, 26, 35 & 27 of the Arms Act.

It has been submitted on behalf of the petitioner that there is case and counter case and there is injury on the petitioner's side also and the allegation is that petitioner fired but did not hit anybody and thereafter he fled away but from his motorcycle one country made pistol has been recovered and petitioner is in custody since 8.1.2017.

Patna High Court Cr.Misc. No.10475 of 2017 (2) dt.20-03-2017 2/2 Having heard both sides and considering the nature of allegation, I am not inclined to grant bail to the petitioner at this stage. He may renew his prayer for bail before the court below itself after completion of four months in custody and learned court below will pass appropriate order considering the period of custody as well as the fact that there is case and counter case between the parties and there is injury on the petitioner's side also. With the above observations and directions, this application is dismissed.
