The petitioner seeks bail in a case instituted for the offences under Sections 392, 174(A) of the Indian Penal Code. Prosecution case, in short, is that that while the informant was going to his village, accused persons took away the motorcycle of the informant and fled away. It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.1.2019. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no recovery of any incriminating articles

Patna High Court CR. MISC. No.10463 of 2019(3) dt.18-04-2019 2/2 from the conscious possession of the petitioner. The petitioner has not been put on T.I.P. Other co-accused has been granted bail vide order dated 5.11.2012 passed in Cr. Misc. No. 33906 of 2012.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Mr. P. K. Bharti, J.M., 1st Class, Jehanabad in connection with Madhdumpur P.S. Case No. 404 of 2010.
