JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 337, 307, 354, 504, 506, 34 of the Indian Penal Code. The prosecution case is that the petitioner made an attempt to outrage the modesty of the daughter of the informant while she was on the way to her school. It is submitted by learned counsel for the petitioner that in fact the informant's side made an attempt to outrage the modesty of the sister of the petitioner on 12.09.2015 and the mother of the petitioner went to make complaint then the case was lodged by the informant, though subsequently the petitioner's case was also registered being Hawai Adda P.S. Case No. 161 of 2015 on 18.09.2015 under Sections 341, 323, 354, 504 of the Indian Penal Code. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.4817 of 2016 (2) dt.04-02-2016 2/2 petition that petitioner has no criminal antecedent. Considering the nature of accusation and the fact that counter version has been lodged with similar accusation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Hawai Adda P.S. Case No. 158 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
