NILU AGRAWAL ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner is languishing in custody since 15.10.2016 in connection with Chapra Rail P.S. Case No. 62/2016 for offences punishable under Sections 379, 411, 34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that he along with his family were travelling by train and near Chapra Junction two boys snatched the purse of his aunt and tried to flee away but were chased and apprehended. Petitioner was one of them and from his custody yellow colour earring and silver payal along with Rs. 500/- was recovered.
It has been submitted by the learned counsel for
Patna High Court Cr.Misc. No.10748 of 2017 (2) dt.29-03-2017 2/2 the petitioner that he is innocent and just because there was dispute regarding his wages as he was a sanitary sweeper in the GRP area, has falsely been implicated in the aforesaid case. It is further submitted that the charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Rail P.S. Case No. 62/2016.
