JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-04-2022 The present petition has been filed for modifying the order dated 15.02.2022 passed in Cr. Misc. No. 43381 of 2021 to the extent that the depiction of the learned court below has been mentioned as " the learned court of S.D.J.M., Daudnagar, Aurangabad" instead of the learned court of Additional Sessions-IInd cum Special Judge, Excise, Gaya. It is submitted by the learned counsel for the petitioner that on account of inadvertence, the depiction of the learned court below had been wrongly mentioned in the main petition itself, however, now in the present modification petition, the correct designation of the learned court below has

Patna High Court CR. MISC. No.13964 of 2022(2) dt.06-04-2022 2/2 been mentioned as " Additional District & Sessions-II cum Special Judge, Excise, Gaya", hence appropriate modification may be made.

Having regard to the facts and circumstances of the case and considering the submissions/ averments made in the present petition, the present petition for modification is allowed and it is directed that the depiction of the learned court below made in last paragraph of the order dated 15.02.2022 be read as "the learned Court of Additional Sessions Judge-IInd cum Special Judge, Excise Act, Gaya". The rest of the order dated 15.02.2022 shall remain as such.
