This application is filed for grant of regular bail in connection with Excise P.S. Case No. 623 of 2022 registered under sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act, 2018.
Learned counsel for the petitioner submits that there is recovery of 492.480 litres of illegal foreign liquor. The petitioner has offered to deposit Rs. 50,000/- (Rupees Fifty Thousand Only) in Ramakrishna Mission Ashrama, Chapra Latu Maharaj Path, Opp. Circuit House, Chapra, Bihar 841301, without accepting his guilt. Patna High Court CR. MISC. No.15559 of 2023(2) dt.22-05-2023 2/3 antecedent and he is in custody since 17.12.2022. Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody of the petitioner and also the fact that he has clean antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Additional Sessions Judge-II -cum- Special Judge, Excise -I, Saran at Chapra in connection with Excise P.S. Case No. 623 of 2022.
The petitioner shall deposit an amount of Rs. 50,000/- (Rupees Fifty Thousand Only), as has been offered by him, in the Ramakrishna Mission Ashrama, Chapra Latu Maharaj Path, Opp. Circuit House, Chapra, Bihar 841301 and will produce the receipt of the same at the time of furnishing the bail bonds in the court below. The bail bonds of the petitioner shall be accepted only after he produces the receipt of Rs. 50,000/- (Rupees Fifty Thousand Only) issued by the Ramakrishna Mission Ashrama, Chapra and after verification of the genuineness of the said receipt from concerned Ramkrishna Mission, Ashram.
