Petitioner is in custody in connection with Excise Case No. 03 of 2019 for the offence under section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent.

In the instant case total 148 liters of liquor was seized. Learned counsel for the petitioner would submit that nothing was recovered from the conscious possession of the petitioner but from the open space of the house of the petitioner. Learned counsel submits that petitioner is in custody since 5.1.2019.
