The petitioner seeks bail in Nawanagar P.S. Case No. 144/2018, Ex. G.R. No. 931/2018, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner has submitted that petitioner is not named in the written report. There is no recovery of any incriminating article from possession of this petitioner. It is alleged in the written report that police intercepted one truck, which was found loaded with 990 cartons, containing 47250 bottles of 180 ml. each of foreign liquor. It is alleged that two persons were apprehended and two persons managed to run away. The apprehended persons disclosed that co-accused Dhirendar Singh @ Dharu had ordered for the said wine.
Learned Addl. Sessions Judge, Buxar has mentioned in the
Patna High Court CR. MISC. No.11410 of 2019(2) dt.26-02-2019 2/2 impugned order that during investigation name of petitioner has been disclosed by one co-accused in his confessional statement as partner in selling of liquor. Thereafter police arrested the petitioner and recorded his confessional statement.
It is mentioned in para 3 of bail petition one other case of Excise Act is pending against this petitioner. Petitioner is in custody since 18.12.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise, Buxar in connection with Nawanagar P.S. Case No. 144/2018, Ex. G.R. No. 931/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. The petitioner will file affidavit at the time of filing bail bond that he would not indulge in such type of activity in future. In the event, he is found indulged in such type of activity, his bail bond in the instant case will liable to be cancelled. (Sanjay Priya, J) rakhi/- U T
