The petitioner apprehends his arrest in a case registered under Section 47(a) and (F) of the Bihar Excise Act. According to the prosecution report, the house of the petitioner was raided and from there, 15 litres of country-made liquor and 200 kg of Jawa Mahua were recovered. Learned counsel for the petitioner submits that nothing was recovered from the exclusive possession of the petitioner.
It appears that the recovery was made from the house of the petitioner. Hence, I am not inclined to enlarge the petitioner on anticipatory bail in G.O. Case No. 90/2014. Accordingly, the same is rejected.
The petitioner is directed to surrender in the court
Patna High Court Cr.Misc. No.6765 of 2015 (2) dt.19-02-2015 2/2 below within four weeks from today and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner without being prejudiced by this order. (Prabhat Kumar Jha, J) Dilip/- U T
