====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Sasaram (Model) P.S. Case No. 1483 of 2018, instituted for the offence under Section(s) 304B and 120B of the Indian Penal Code. Counsel for the petitioner submits that petitioner is father-in-law of the deceased.
It is alleged in the written report that daughter of the informant was tortured in her sasural for non-fulfillment of demand of dowry. It is further alleged that during her pregnancy period, the accused persons did not take proper care. On 4.12.l2018 the daughter of informant was blessed with a female child at Dularchand Hospital where she became serious
Patna High Court Cr.Misc. No.10405 of 2019(2) dt.21-02-2019 2/2 and was referred to Varanasi, but on account of excess bleeding, she died on the way.
Counsel for the petitioner submits that petitioner is father-in-law of the deceased. There is no allegation of any specific overt act against him.
Petitioner is in custody since 6.12.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram, in connection with Sasaram (Model) P.S.
