The petitioner seeks bail in Hajipur Town P.S. Case No. 397 of 2021, registered for the offence punishable punishable under Section 30(a), 32(ii) of the Bihar Prohibition and Excise Act, 2018.

82 litres of Indian made foreign liquor has been recovered from a tempo and one mobile was also recovered, on the basis of which petitioner's name surfaced in this case during course of investigation.

It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and has got no concern with the seized liquor. Petitioner claims clean antecedent and he

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Special Judge 2nd-cum-Special Judge Excise, Hajipur, Vaishali in connection with Hajipur Town P.S. Case No. 397 of 2021.
