Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Dariyarpur P.S. Case No. 98 of 2015 instituted for the offence under Sections 341, 323, 324, 307/34 of the Indian Penal Code and 27 of Arms Act. It is submitted that petitioner is in custody since 07.12.2016. The petitioner is alleged to have caused fire-arm injury but doctor has found no fire-arm injury on the person of the informant.
As per written report, petitioner fired which hit on the back of the informant. The injury report has been annexed as
Patna High Court Cr.Misc. No.8749 of 2017 (2) dt.16-03-2017 2/2 Annexure-2 where the doctor has found cut injury in front of neck, lacerated wound on left thumb, lacerated wound on right index finger and abrasion in front of neck on left shoulder of the informant.
As such, from the injury report, no fire-arm injury appears to have been caused to the informant. The petitioner is in custody since 07.12.2016. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10, 000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Dariyarpur P.S. Case No. 98 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner.
