JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Chenari P.S. Case No. 295 of 2019, registered under Sections 341, 323, 326, 379, 504 and 506/34 of the Indian Penal Code. The accusation is that petitioner along with 3 to 4 unknown came at the door of the informant, Shiv Shankar Prasad, and started to cause assault to his son, Rahul Kumar, in which, his son, Rahul Kumar sustained injury at his teeth, head arm.
Learned counsel for the petitioner submits that due to draining out the house water, occurrence took place, in which, three injuries were found on the person of son of the informant.
Patna High Court CR. MISC. No.9870 of 2020(2) dt.28-02-2020 2/2 Out of three injures, only one grievous injury is said to be found on the teeth of his son, Rahul Kumar. Further submission is that petitioner has no criminal antecedent and is in custody since 20.12.2019.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IV-cum-S.J.-XII, Saharsa, Rhotas, in connection with Chenari P.S. Case No. 295 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
