JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 420/354/504/506 of the Indian Penal Code.

There are allegations against the petitioner; first that he has already married with the informant and second that he got an ATM card prepared in respect of the pension account of mother of the informant and withdrew money from that account on different occasion to the tune of Rs.8,00,000/-. Submission of the petitioner is that the F.I.R. would reveal that the real relationship has been suppressed

Patna High Court Cr.Misc. No.19402 of 2017 (2) dt.25-04-2017 2/2 deliberately. It is not possible that even by authority a person can get ATM card as well as PIN number standing in the name of some other person.

Learned counsel for the informant opposed the prayer of bail.

Considering the entire facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/Successor Court, in connection with Narpatganj P.S. Case No.327 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
